Description of Agency

The Michigan Indigent Defense Commission (MIDC) is responsible for developing and overseeing the implementation, enforcement, and modification of minimum standards, rules, and procedures to ensure indigent criminal defense services are effective for providing counsel to all indigent adults consistent with the safeguards of the U.S. Constitution, Michigan Constitution, and Michigan Indigent Defense Commission Act. MIDC provides grants to indigent criminal defense systems (local systems) to assist in bringing the local systems into compliance with minimum standards established by MIDC. MIDC is composed of 19 commissioners and is responsible for hiring an executive director who oversees 17 employees, as of March 2025, to assist MIDC in carrying out its responsibilities. MIDC was appropriated approximately $220.9 million and $258.3 million for fiscal years 2024 and 2025, respectively, for distribution to approximately 120 local systems for indigent criminal defense services.

Audit Objectives

  1. To assess the sufficiency of MIDC’s efforts to monitor local systems’ compliance with MIDC’s standards for indigent criminal defense services.
  2. To assess the effectiveness of MIDC’s efforts to administer MIDC grant funds.
  3. To assess the sufficiency of MIDC’s efforts to establish a complaint process as required by the Michigan Indigent Defense Commission Act.
